Terms & Conditions, Cancellation and Refund Policies for Empower Your Destiny, Australia as of ………. November 2023

 On your enrolment agreement which you signed, there are some points about cancellation – they are part of this cancellation policy. When you enrolled for this training, you had available coaching support from a coach/trainer (whether you have chosen to use it or not). The refund policy is based on that support as well as the training materials you received when you enrolled (if any).

 You have acknowledged on the enrolment form that the non-refundable cancellation fee may only be applied to a future training with Empower Your Destiny (EYD) for two (2) years from the date of the enrolment agreement. You can choose to extend this by paying the current rollover fee.

 If you decide not to attend the training you initially enrolled into, as long as you advise us of this at least two (2) months before the commencement of the training, the amount paid by you will be refunded after a deduction of a minimum $1,500 per training, with the actual amount to be withheld being based on retail price for the materials provided to you by that time. The amount will be refunded using the same method as the payment towards the training was made.

• Cooling off – In relation to your enrolment, you have three (3) days cooling off period (if you are a resident or citizen of USA or Canada) or seven (7) days cooling off period (for the rest of the world other than USA or Canada) and have part of your deposit refunded after a deduction of $500, unless the training course is due to commence within that time in which case no cooling off or refund shall be applicable. After that time, these cancellation policies apply. Please note, if you were given or sent any material, online or hard copies (such as books, manuals, etc.) after payment of deposit by you, you will be liable to pay retail price for such material, which shall be deducted from any deposit paid by you before issuing any refund to you. If the deposit paid is less than the retail price of the material provided to you, then you shall remain liable to pay the balance.

 If you have paid an amount towards a training you have enrolled into, and that amount is less than or is the same as the deposit, then no refund will be given, regardless of when you cancel the training.

 You may have entered into a payment plan with us and/or received a discount. You must make the payments in time. Failure to do so will result in termination of payment plan and revocation of any discount and you will be required to pay the full price for the training and/or pay a penalty.

 If you cancel your enrolment within or less than two (2) months of the start of the training that you have initially enrolled into, then no refund will be given, and your complete payment will be credited to the next training of your choice (within maximum of 2 years or less from the date of the first payment (known as deposit)). You may also decide to purchase our product(s) for up to the value of the amount paid by you, less the amount of the deposit and a $1,500 cancellation fee.

 If you let us know personally during the first session of the training, that the training is not for you and you do not wish to continue that training, we will refund part of the tuition fee paid by you after deducting the deposit and cost of material already provided to you. In that case, your online access to our portal will also be terminated. You will not be entitled to claim any compensation from us in this regard.

 If you do not show up at the training or abandon the training at any point during the training, no refund shall be provided to you, and if you have not paid the full fee for the training by that time, you will be liable to pay the full training fee. At the sole and absolute discretion of the Empower Your Destiny management you may be able to select another training if it is within the 2-year period as specified above.

 If, during the seminar/training you are found unfit or disruptive to participate in that training by a representative and/or staff member of Empower Your Destiny, you will be required to leave the training immediately. No questions or discussions will be entered into, and Empower Your Destiny representatives and/or staff will be the sole judge. In this case, no refunds will be given and you will be required to hand back on the spot all training materials including manuals provided to you for the training.

 In the case of a national emergency, an Act of God, terrorism or a natural disaster, training dates or locations may be changed at the sole and absolute discretion of EYD. In that case, no refund will be due. The credit may be transferred to another training or used to purchase EYD product(s).

 In case you cannot attend (for whatever reasons) a face-to-face training session, you agree that attending the training online (if available) would be acceptable and would be a suitable replacement. All associated costs arising from this choice would be your responsibility.
